All disputes arising under this Agreement will be resolved by confidential binding arbitration, conducted in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed upon arbitration provider.
Arbitration will take place in Butte-Silver Bow County, Montana, or another mutually agreed upon location. Any arbitration fees will be governed by the rules of the arbitration provider, and LanceShorts may advance these fees under certain circumstances. The decision of the arbitrator will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
You agree that any dispute resolution will be conducted on an individual basis. You waive any right to participate in a class action or other consolidated or representative proceeding.
You may opt out of this arbitration agreement by notifying us in writing within 30 days of accepting these Terms. However, opting out of the arbitration agreement does not affect any other parts of this Agreement, and you will still be subject to the governing law and venue provisions.
This Agreement will be governed by and construed under the laws of the State of Montana, without regard to conflict of laws principles. Any disputes not subject to arbitration will be litigated in state or federal courts located in Butte-Silver Bow County, Montana.
By using the site, you consent to receive electronic communications from us, including emails, texts, and notifications posted on the site. These communications will satisfy any legal requirements for written communication.
You agree to keep confidential any non-public information regarding LanceShorts. Disclosure of such information without prior written consent is prohibited.
We may terminate this Agreement and your access to the site at any time, for any reason, without notice. Upon termination, you must cease all use of the site and any content you have submitted prior to termination will remain subject to this Agreement.
If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect.
This Agreement constitutes the entire understanding between you and LanceShorts with respect to your use of the site. It supersedes all prior agreements and can only be modified in writing.
LanceShorts reserves all rights not expressly granted in this Agreement.
